Terms of Service
These Terms of Service govern your access to and use of XPward, including the XPward iOS app, xpward.com, account services, cloud features, and related functionality.
1. Agreement and scope
By creating an XPward account, accessing XPward, or using any XPward feature, you agree to these Terms of Service and acknowledge the XPward Privacy Policy. If you do not agree, do not use XPward.
XPward is a productivity and self-improvement service that can help you record activities, earn XP, manage quests and goals, track streaks and progress, use widgets and reminders, select or upload a profile image, and use other features made available from time to time.
XPward is operated by the developer identified in the applicable Apple App Store listing. In these Terms, “XPward,” “we,” “us,” and “our” refer to that operator.
2. Eligibility
You may use XPward only if you are legally capable of entering into these Terms or are using the service with the permission and supervision required by the laws that apply to you. XPward is not intended to be used by children below the minimum age at which they may independently consent to an online service in their jurisdiction without appropriate parent or guardian involvement.
If you use XPward on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms.
3. Accounts and account security
Some XPward features require an account. You agree to provide information that is accurate enough for the service to function, keep your credentials secure, and promptly update information that becomes materially inaccurate.
You are responsible for activity performed through your account unless the activity results from a security failure for which applicable law makes XPward responsible. Do not share passwords or authentication credentials with people who should not have access to your account.
You may sign in using email and password, Google Sign-In, Sign in with Apple, or other methods XPward may support. Your use of a third-party identity provider is also subject to that provider’s terms and policies. XPward never needs your Google or Apple account password.
4. Limited license to use XPward
Subject to these Terms, XPward grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use XPward for lawful personal or internal business productivity purposes.
This license does not permit you to sell, sublicense, rent, lease, reverse engineer where prohibited by law, defeat technical protections, scrape the service at abusive scale, or use XPward to build a competing service by copying protected elements of XPward.
5. Your content and profile materials
You retain ownership of the text, task information, goal information, notes, profile images, and other content you submit to XPward to the extent you have rights in that content.
You grant XPward a limited, worldwide, non-exclusive license to host, store, reproduce, process, transmit, format, and display your content only as reasonably necessary to operate, secure, synchronize, maintain, and improve the XPward service or comply with law. This license ends when the content is deleted from active systems, subject to limited retention permitted by the Privacy Policy or applicable law.
You are responsible for ensuring that content you upload or enter does not violate another person’s rights, confidentiality, privacy, intellectual property, or applicable law. Do not upload a custom profile image that you do not have permission to use.
6. Acceptable use
You agree not to misuse XPward. Prohibited conduct includes:
- using XPward for unlawful, fraudulent, abusive, threatening, or deceptive activity;
- attempting to gain unauthorized access to accounts, systems, APIs, databases, or infrastructure;
- distributing malware, malicious code, or content intended to interfere with the service;
- automating requests in a way that materially degrades XPward or bypasses reasonable limits;
- impersonating another person or misrepresenting your authority;
- uploading content that infringes third-party rights or violates applicable law;
- circumventing access controls, plan restrictions, security controls, or payment mechanisms;
- using XPward in a way that creates unreasonable legal, security, or operational risk for other users or the service.
We may take proportionate action to protect XPward, including rate limiting, blocking abusive traffic, restricting features, or suspending accounts that materially violate these Terms.
7. AI-assisted features
XPward may offer optional AI-assisted planning, analysis, summaries, or suggestions. AI output can be incomplete, outdated, misleading, or wrong. You are responsible for reviewing AI-generated output before relying on it or acting on it.
AI features are provided for general productivity purposes and are not a substitute for professional medical, legal, financial, safety, or other regulated advice. Do not use AI output as the sole basis for decisions where an error could cause significant harm.
When you intentionally submit content to an AI-powered feature, that content may be transmitted to the applicable AI service provider as described in the Privacy Policy.
8. Third-party services and links
XPward relies on third-party services for functions such as hosting, databases, object storage, email delivery, authentication, Apple platform services, and optional AI processing. Third-party services operate under their own terms and privacy policies.
XPward may contain links that open external websites or apps. We are not responsible for third-party content, availability, policies, or transactions that occur outside XPward, except where applicable law provides otherwise.
9. Paid features, subscriptions, and purchases
XPward may offer free and paid functionality. If a paid plan, subscription, one-time purchase, or other paid feature is offered, the price, billing period, included features, renewal terms, and applicable purchase conditions will be displayed before purchase.
Purchases made through Apple are processed by Apple and are subject to Apple’s payment, subscription, cancellation, and refund rules. XPward does not control Apple’s billing systems. Where other payment methods are lawfully offered, the terms displayed at checkout also apply.
Unless required by law or the applicable store’s rules, XPward does not guarantee that a feature available under one plan will remain unchanged forever. Material changes to paid services will be handled in accordance with applicable law and any commitments made at purchase.
10. Beta features, TestFlight, and service changes
Pre-release, beta, TestFlight, experimental, or preview features may be less stable, incomplete, or changed more frequently than production features. They may contain bugs, lose compatibility, or be withdrawn.
We may add, modify, redesign, suspend, or discontinue features when reasonably necessary for product development, security, legal compliance, third-party dependency changes, or operational reasons. Where applicable law requires notice or preserves specific consumer rights, those requirements remain in effect.
11. XPward intellectual property
XPward, including its software, interface, branding, logos, original avatars, graphics, design elements, documentation, and other materials supplied by XPward, is owned by or licensed to the XPward operator and is protected by applicable intellectual property laws.
Except for the limited license granted in these Terms, no right, title, or interest in XPward intellectual property is transferred to you. You may provide feedback or suggestions. If you do, you allow XPward to use that feedback without an obligation to compensate you, provided we do not claim ownership of your underlying personal content.
12. Availability, synchronization, and backups
XPward is designed to synchronize supported account data across devices, but no online service can guarantee uninterrupted access, perfect synchronization, or permanent storage. Network failures, device conditions, software bugs, provider outages, maintenance, security incidents, and other events can affect availability.
You should keep independent copies of information that would be seriously harmful for you to lose. XPward is a productivity service, not an archival, emergency, safety-critical, or guaranteed backup service.
13. Account deletion
You can request permanent account deletion from within the XPward iOS app. Account deletion is intended to remove your XPward account and associated active cloud data as described in the Privacy Policy. Where available, XPward also attempts to remove account-owned custom avatar storage and revoke Sign in with Apple authorization.
Deletion is intended to be irreversible. After deletion, you may create a new account using the same email if the service permits it, but the new account is treated as a new XPward account and deleted progress may not be recoverable.
Limited records may be retained where required by law or reasonably necessary for security, fraud prevention, dispute resolution, or enforcement, as explained in the Privacy Policy.
14. Suspension and termination
You may stop using XPward at any time and may delete your account through the available in-app controls.
XPward may restrict or suspend access if reasonably necessary to address a serious Terms violation, fraud, security threat, unlawful use, abuse of infrastructure, or legal requirement. Where appropriate and feasible, we will prefer proportionate measures and may provide notice or an opportunity to resolve the issue.
Sections that by their nature should survive termination—including intellectual property, disclaimers, liability limits, dispute provisions, and obligations relating to previously submitted content—continue to apply after termination to the extent permitted by law.
15. Disclaimers
To the maximum extent permitted by applicable law, XPward is provided on an “as is” and “as available” basis. We do not promise that every feature will always be uninterrupted, error-free, compatible with every device, or suitable for every personal workflow.
XP, streaks, goals, achievements, reports, reminders, AI suggestions, and other productivity indicators are motivational or organizational features. They do not guarantee any real-world result, performance improvement, income, health outcome, academic result, or other outcome.
Nothing in these Terms excludes warranties, remedies, or consumer protections that cannot lawfully be excluded.
16. Limitation of liability
To the maximum extent permitted by law, XPward and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, opportunities, goodwill, or data, arising from your use of or inability to use XPward.
Where liability cannot legally be excluded, liability will be limited only to the extent permitted by applicable law. These limitations do not apply to liability that cannot be limited under mandatory consumer law, including where applicable liability for fraud, intentional misconduct, or personal injury caused by legally actionable negligence.
17. Governing law and consumer rights
These Terms are governed by the laws of Greece, without regard to conflict-of-law principles, except that mandatory consumer protections of your country of residence continue to apply where the law requires them to.
If you are a consumer in the European Economic Area, United Kingdom, or another jurisdiction with mandatory consumer rights, nothing in these Terms removes rights that cannot legally be waived. Any dispute forum or court requirement in these Terms applies only to the extent permitted by the consumer law that applies to you.
Before starting formal proceedings, we encourage you to contact us so we can try to resolve the issue informally.
18. Changes to these Terms
We may update these Terms when XPward features, business models, laws, providers, security requirements, or operating practices change. The “Last updated” date identifies the current version.
If a change is material and applicable law requires notice or consent, we will provide the required notice or obtain consent before the change takes effect for affected users. Continuing to use XPward after an effective update means the updated Terms apply to future use, subject to mandatory law.
